This End User License Agreement ("Agreement") is a legal agreement between you ("you", "the player") and the Arcfall team ("we", "us", "our") governing your use of the Arcfall game, including the application, its content, updates, and related services (collectively, the "Game"). By downloading, installing, accessing, or playing the Game, you agree to be bound by this Agreement. If you do not agree, do not install or use the Game.
1. License Grant
Subject to your continued compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use one copy of the Game on devices you own or control, solely for your personal, non-commercial entertainment. We reserve all rights not expressly granted to you.
2. Restrictions
You agree that you will not, and will not permit others to:
- copy, modify, translate, or create derivative works of the Game;
- reverse engineer, decompile, or disassemble any part of the Game, except where such restriction is prohibited by applicable law;
- use cheats, automation software, bots, exploits, modified clients, or any unauthorized third-party software to gain an unfair advantage;
- rent, lease, lend, sell, sublicense, or otherwise commercially exploit the Game or any part of it;
- remove, alter, or obscure any proprietary notices, logos, or trademarks;
- disrupt, interfere with, or place undue load on the Game's servers, the Solana network, or other players.
3. Wallet, Keys & On-Chain Transactions
Arcfall uses a Solana wallet for sign-in and for in-game payments. You are solely responsible for safeguarding your wallet, seed phrase, and private keys. We never request, store, or have access to your private keys. Any transaction you authorize and broadcast to the Solana blockchain is final, irreversible, and recorded on a public ledger. We do not custody your funds and cannot reverse, refund, or recover on-chain transactions.
4. Virtual Items & $SKR
The Game may offer virtual items, currencies, and content that can be unlocked or purchased using the SKR token as the in-game payment and top-up currency. You acknowledge that:
- virtual items and in-game content are licensed to you for use within the Game, not sold, and you obtain no ownership interest in them;
- SKR is used as a payment / recharge method only — the Game does not offer a mechanism to earn or be rewarded SKR through gameplay;
- all purchases of virtual items are final and non-refundable except where required by applicable law;
- we may, at our discretion, modify, manage, or discontinue virtual items and pricing at any time;
- the value, availability, and tradability of any token are subject to factors outside our control, and we make no representation that any item or token has or will retain real-world value.
5. Intellectual Property
The Game and all of its content — including code, artwork, characters, audio, text, and trademarks — are owned by us or our licensors and are protected by intellectual property laws. This Agreement does not transfer any ownership rights to you. The "Arcfall" name, logo, and emblem are our trademarks.
6. User Conduct
You agree to use the Game lawfully and respectfully. You will not use the Game to harass others, transmit unlawful or infringing content, attempt to access accounts or wallets that are not yours, or engage in fraud or money laundering. We may suspend or terminate access for conduct that violates this Agreement or harms other players.
7. Disclaimer of Warranties
The Game is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Game will be uninterrupted, secure, or error-free, or that the Solana network or any third-party service will be available.
8. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of funds, tokens, data, or profits, arising out of or related to your use of the Game — including losses caused by your handling of your wallet or keys, or by on-chain transactions. Where liability cannot be excluded, it is limited to the amount you paid to us, if any, in the three months preceding the claim.
9. Termination
This Agreement is effective until terminated. Your rights under it terminate automatically if you breach any of its terms. Upon termination, you must stop using and delete the Game. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.
10. Changes to This Agreement
We may update this Agreement from time to time. Material changes will be reflected by updating the "Last updated" date above. Your continued use of the Game after changes take effect constitutes acceptance of the revised Agreement.
11. Governing Law
This Agreement is governed by the applicable laws of the jurisdiction in which the Arcfall team operates, without regard to conflict-of-laws principles. Nothing in this Agreement limits any consumer rights that cannot be waived under your local law.
